Terms of Service

By using GEMLINE you agree to these terms. Please read them carefully. The key points: you must own any card you list, we charge a 10% transaction fee on sales, and all disputes go through our resolution process before any legal action.
1. About GEMLINE
GEMLINE is a peer-to-peer marketplace for buying, selling, bidding on, and trading professionally graded trading cards. GEMLINE operates as a platform connecting buyers and sellers — we are not a dealer or broker in the cards themselves.
2. Eligibility
- You must be at least 18 years old to use GEMLINE.
- You must be a legal resident of a jurisdiction where such transactions are lawful.
- You may only have one account. Creating multiple accounts to circumvent restrictions is prohibited.
- You are responsible for maintaining the security of your account credentials.
3. Listings and Sales
What you can list
- Only cards you personally own and have the legal right to sell.
- Cards must be accurately described — correct grader, grade, year, set, and condition.
- Graded cards must match the cert number entered at listing. Misrepresentation is grounds for immediate account suspension.
What you cannot list
- Counterfeit, altered, or trimmed cards
- Cards with fabricated or misrepresented grades
- Items you do not own or have the right to sell
- Cards subject to legal dispute or liens
Pricing
Sellers set their own prices. GEMLINE provides market data for reference only — we do not guarantee any card will sell at any particular price. All prices are in USD.
4. Auctions
- Once an auction is live, the starting bid and duration cannot be changed.
- Bids are binding commitments to purchase at that price if you win.
- Shill bidding (bidding on your own listings or having others do so) is strictly prohibited and will result in permanent ban.
- The highest bid at the end of the auction timer wins. If a reserve price was set and not met, the seller is not obligated to sell.
- Auction winners must complete payment within 48 hours or forfeit the win.
5. Fees
- Seller fee: 10% of final sale price, deducted at settlement.
- Buyer fee: None on standard purchases. Auction wins may include a 2% buyer's premium on high-value lots (over $5,000).
- Boost credits: Optional. Purchased credits used to promote listings are non-refundable.
- GEMLINE reserves the right to update fee structures with 30 days' notice.
6. Payments and Escrow
All payments are processed through Stripe. When you purchase a card, your payment is held in escrow until the transaction is confirmed complete. Funds are released to the seller upon:
- Vault custody transfer (for vault-held cards), or
- Buyer confirmation of receipt (for shipped cards)
GEMLINE is not responsible for chargebacks initiated outside our platform. Chargebacks that circumvent our dispute process may result in account suspension.
7. Trades
Card-for-card trades are between users directly. GEMLINE facilitates the escrow and transfer but is not a party to the trade agreement. Both parties must confirm the trade before cards are transferred. Once confirmed, trades are final.
8. Prohibited Conduct
- Fraud, misrepresentation, or deception of any kind
- Shill bidding, wash trading, or price manipulation
- Harassment, threats, or abusive behavior toward other users
- Circumventing fees by transacting off-platform after meeting on GEMLINE
- Scraping, reverse engineering, or automated access to GEMLINE
- Attempting to compromise the security of the platform
9. Disputes
If you have a dispute with another user:
- Contact GEMLINE support at support@gemline.auction within 7 days of the transaction.
- GEMLINE will review the case and make a determination within 5 business days.
- GEMLINE's decision is final for transactions under $500. For larger disputes, binding arbitration is available.
GEMLINE may hold escrowed funds during an open dispute until resolution.
10. Intellectual Property
GEMLINE and its logo are trademarks of GEMLINE. Card images shown on the platform are used for identification purposes. All card imagery remains the property of their respective manufacturers (Panini, Topps, PSA, etc.).
11. Limitation of Liability
GEMLINE is provided "as is." We are not liable for losses arising from: market price fluctuations, third-party shipping damage, fraud by other users, or platform outages. Our maximum liability to you for any claim is limited to fees you paid to GEMLINE in the 90 days prior to the claim.
12. Termination
GEMLINE may suspend or terminate accounts at our discretion for violations of these terms. Users may delete their account at any time. Active listings will be removed and pending transactions will be resolved according to this policy.
13. Changes to These Terms
We may update these terms at any time. Continued use of GEMLINE after changes constitutes acceptance. We'll notify you of material changes via email or in-app notification.
14. Governing Law
These terms are governed by the laws of the United States. Any disputes not resolved through our process will be subject to binding arbitration under JAMS rules.
